A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section, designated §21-5C-2a, relating to prohibiting local government entities from setting prevailing wages.

Be it enacted by the Legislature of West Virginia:


That the Code of West Virginia, 1931, as amended, be amended by adding thereto a new section, designated §21-5C-2a, to read as follows:

ARTICLE 5C. MINIMUM WAGE AND MAXIMUM HOURS STANDARDS FOR EMPLOYEES.


§21-5C-2a.  Setting prevailing wages prohibited.

Whereas the provisions of article five-a of this chapter relating to what is known as prevailing wages were repealed by a previous act of the Legislature, it is the intent of the Legislature to clarify and declare that local government entities may not establish or set prevailing wages for construction of public improvements or any other undertaking.

 

NOTE: The purpose of this bill is to prohibit local government entities from setting prevailing wages.
