A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section, designated §29-3-16d, relating to requiring the installation, maintenance or service of fuel gas systems in one- or two-family dwellings according to the State Fire Code and the rules promulgated thereunder if such installation is performed by any persons other than the owner or occupant of a single-family dwelling.

Be it enacted by the Legislature of West Virginia:
That the Code of West Virginia, 1931, as amended, be amended by adding thereto a new section, designated §29-3-16d, to read as follows:
ARTICLE 3. FIRE PREVENTION & CONTROL ACT.
§29-3-16d. Performance of Installation of Propane Gas Systems.

(a) Notwithstanding any statutory or regulatory provisions to the contrary, any person who installs, fuels, maintains or services any fuel gas system to a one or two family dwelling shall comply with this article and the rules promulgated under this article relating to fuel gas systems.
(b) This section does not apply to any person who performs such work on a single family dwelling owned or leased, and occupied by that person. The personal exemption provided in this subsection is the same as the personal exemption provided in the Supervision of Fire Protection Work Act, §29-3D-1, et seq., (2007), in particular §29-3D-3(c)(1).



NOTE: This bill shall require any person who installs, fuels, maintains or services any fuel gas system to a one or two family dwelling to comply with this article and the rules promulgated under this article relating to fuel gas systems, excluding any person who performs such work on a single family dwelling owned or leased, and occupied by that person.


§29-3-16d is new; therefore, strike-throughs and underscoring have been omitted.
