A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section, designated §18C-1-6, relating to the recision of higher education loans, scholarships or other financial aid from students who receive two or more citations for an open container violation, DUI, underage consumption, public intoxication or contributing to the delinquency of a minor.

Be it enacted by the Legislature of West Virginia:
That the Code of West Virginia, 1931, as amended, be amended by adding thereto a new section, designated §18C-1-6, to read as follows:
ARTICLE 1. FINANCIAL ASSISTANCE GENERALLY.
§18C-1-6. Recision of state financial aid for illegal consumption or possession of alcohol.

(a) Any student receiving any form of state financial aid, including, but not limited to, the PROMISE scholarship and other programs established in chapter eighteen-c of this code, shall lose that financial aid if they receive two or more citations for a violation of a state law or municipal ordinance which pertains to illegal possession or consumption of alcohol, including, but not limited to, underage consumption or possession, open container violation, DUI, public intoxication or contributing to the delinquency of a minor.
(b) This section is effective and pertains to citations received on and after the first day of July, two thousand eight.


NOTE: The purpose of this bill is to rescind state financial assistance from students
who receive two or more citations for an open container violation, DUI, underage consumption, public intoxication or contributing to the delinquency of a minor.
