HOUSE CONCURRENT RESOLUTION NO. 85

Requesting the Joint Committee on Government and Finance to study the utility of transferring licensing authority of private investigative and security services from the Secretary of State to the Division of Criminal Justice Services.

Whereas, The Secretary of State currently has licensing authority over private investigative and security services in West Virginia; and
Whereas, Private investigative and security services in West Virginia are inherently intertwined with our state's criminal justice system; and
Whereas, In many states, private investigative and security services are licensed and regulated by an agency which has administrative authority over some aspect of that state's criminal justice system; and
Whereas, A similarly situated agency in this state with expertise in the field of criminal justice would be a more appropriate venue to license and regulate private investigative and security services in our state; therefore, be it
Resolved by the Legislature of West Virginia:
That the Joint Committee on Government and Finance is hereby requested to study the utility of transferring licensing authority of private investigative and security services from the Secretary of State to the Division of Criminal Justice Services; and, be it
Further Resolved, That this study shall utilize Committee Substitute for H.B. 4141, 2010 Regular Session, as a potential model for effectuating the transfer of licensing authority of private investigative and security services from the Secretary of State to the Division of Criminal Justice Services; and, be it
Further Resolved, That the Joint Committee on Government and Finance report to the regular session of the Legislature in, 2011, on its findings, conclusions and recommendations, together with drafts of any legislation necessary to effectuate its recommendations; and, be it
Further Resolved, That expenses necessary to conduct this study, to prepare a report and to draft necessary legislation be paid from legislative appropriations to the Joint Committee on Government and Finance.
