A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section, designated §21-1B-3a, relating to employer verification of the legal status of workers using an electronic verification program, the “E-Verify program”, for all state agencies.

Be it enacted by the Legislature of West Virginia:

    That the Code of West Virginia, 1931, as amended, be amended by adding thereto a new section, designated §21-1B-3a, to read as follows:

ARTICLE 1B. VERIFYING LEGAL EMPLOYMENT STATUS OF WORKERS.

§21-1B-3a. E-Verify program for state agencies.

    (a) All agencies of the state shall be enrolled in the E-Verify program by January 1, 2013, and on and after this date, use the program for each newly hired employee who is to perform work within the state.

    (b) For purposes of this section, “E-Verify program” means the electronic verification of work authorization program of the Illegal Immigration Reform and Immigrant Responsibility Act of 1996, Public Law 104-208, Division C, Title IV, §403(a), as amended, operated by the United States Department of Homeland Security, or a successor work authorization program designated by the United States Department of Homeland Security or other federal agency authorized to verify the work authorization status of newly hired employees under the Immigration Reform and Control Act of 1986, Public Law 99-603.



    NOTE: The purpose of this bill is to require employer verification of the legal status of workers using an electronic verification program, the “E-Verify program”, for all state agencies.
