A BILL to amend and reenact §60-2-15 of the Code of West Virginia,
1931, as amended, relating to making the Alcohol Beverage
Control Commissioner promulgate consistent regulations of
advertisements in bars of alcoholic liquors and
nonintoxicating beers.
Be it enacted by the Legislature of West Virginia:
That §60-2-15 of the Code of West Virginia, 1931, as amended,
be amended and reenacted to read as follows:
ARTICLE 2. ALCOHOL BEVERAGE CONTROL COMMISSIONER.
§60-2-15. Regulation of advertising.
(a) The commission shall prescribe regulations governing the
advertising of alcoholic liquors
and nonintoxicating beers in this
state. The regulations shall prohibit advertising that encourages
intemperance, induces minors to purchase, or tends to deceive or
misrepresent.
(b) Regulations promulgated by the commission concerning
advertisements for alcoholic liquors and nonintoxicating beers solely contained within a bar or private club shall be identical.
NOTE: The purpose of this bill is to require the commission to
draft identical regulations for advertisements of alcoholic liquors
and nonintoxicating beers contained within a bar or private club.
