A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section, designated §19-1-4e, relating to permitting the sale of raw milk; and authorizing rule-making.

Be it enacted by the Legislature of West Virginia:

    That the Code of West Virginia, 1931, as amended, be amended by adding thereto a new section, designated §19-1-4e, to read as follows:

ARTICLE 1. DEPARTMENT OF AGRICULTURE.

§19-1-4e. Sales of raw milk permitted;                  rule-making.

    (a) The sale of raw milk from cows shall be permitted in this state effective January 1, 2015.

    (b) The commissioner of agriculture shall propose rules, including regulatory standards, for legislative approval in accordance with article three, chapter twenty-nine-a of this code for the purpose of carrying out the requirements of subsection (a) of this section by October 1, 2014.




    NOTE: The purpose of this bill is to permit the sale of raw milk effective January 1, 2015. The bill authorizes rule-making.
