A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section, designated §18A 2-3a, relating to allowing county boards of education to hire retired teachers; providing that retired teachers may work for county board without effect on retirement benefits.

Be it enacted by the Legislature of West Virginia:


That the Code of West Virginia, 1931, as amended, be amended by adding thereto a new section, designated §18A-2-3a, to read as follows:

ARTICLE 2. SCHOOL PERSONNEL.


§18A-2-3a. Reemployment of retired teachers.


(a) The Legislature hereby finds and declares that shortages of qualified teachers and diverse circumstances among the counties support the expanded use of retired teachers.

(b) The county boards of education may offer full-time positions to retired teachers for a salary of no more than eighty percent of their salary at the time of retirement.

(c) A person receiving retirement benefits under article seven-a, chapter eighteen of this code or who is entitled to retirement benefits during the fiscal year in which that person retired may accept employment as a full-time employee for an unlimited number of days each fiscal year without affecting the monthly retirement benefit to which the retirant is otherwise entitled.

 

NOTE: The purpose of this bill is to allow county boards of education to hire retired teachers and provide that retired teachers may work for county board without effect on retirement benefits.
