A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section, designated §16-9A-6, relating to electronic cigarettes and vapor products; requiring the listing of the ingredients contained in the products; and prohibiting the sale of unlabeled vapor products in this state.

Be it enacted by the Legislature of West Virginia:

            That of the Code of West Virginia, 1931, as amended, be amended by adding thereto a new section, designated §16-9A-6, to read as follows:

ARTICLE 9A. TOBACCO USAGE RESTRICTIONS.

§16-9A-6. Required labeling of vapor products.

            All vapor products whether or not that product contains nicotine offered for retail sale in this state must be labeled with a list of the ingredients, arranged by weight in descending order, contained in the portion of the product that is consumed, vaporized or released during the use of the product. No person or business entity may sell or offer for sale any unpackaged vapor product that does not bear this label.

            NOTE: The purpose of this bill is to require the listing of ingredients contained in nicotine-based vapor products offered for retail sale.
