A BILL to amend and reenact §29-3E-10 of the Code of West Virginia, 1931, relating to fireworks safety; and prohibiting counties from regulating the sale and use of consumer fireworks within their boundaries.

Be it enacted by the Legislature of West Virginia:


That §29-3E-10 of the Code of West Virginia, 1931, as amended, be amended and reenacted to read as follows:

ARTICLE 3E. FIREWORKS SAFETY.

§29-3E-10. Local municipalities’ regulation of consumer fireworks; counties prohibited from regulation of consumer fireworks.


This article does not affect the authority of the governing body of a municipality to prohibit or regulate the use of consumer fireworks within its boundaries.

Notwithstanding any other provision of this article or code to the contrary, counties may not regulate the sale or use of consumer fireworks within their boundaries.


 

NOTE: The purpose of this bill is to prohibit counties from regulating the sale and use of consumer fireworks within their boundaries.
