A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section, designated §16-1-9f, relating to public health; and requiring all public accessible restrooms to provide hand sanitizers either in or at the exit from the restroom portion of the public facility.

Be it enacted by the Legislature of West Virginia:

            That the Code of West Virginia, 1931, as amended, be amended by adding thereto a new section, designated §16-1-9f, to read as follows:

ARTICLE 1. STATE PUBLIC HEALTH SYSTEM.

§16-1-9f. Regulation of public facility restrooms.

            (a) The commissioner shall regulate public facility restrooms as prescribed in this section.

            (b) The commissioner shall propose rules for legislative approval in accordance with article three, chapter twenty-nine-a of this code to effect the purposes of this section:

            (1) To inspect and enforce rules to control the sanitary conditions of and license all public facilities and health care facilities as set forth in this chapter, whether public or private open to the general public, including all schools, colleges or universities, and inviting public patronage or public assembly including a requirement that all public facility restrooms provide hand sanitizers either inside the restroom facility or at the exit from the public restroom; and

            (2) To make inspections of these public facilities regarding the sanitary conditions without regard to whether they are publicly or privately owned as long as there is public access.

 


            NOTE: The purpose of this bill is to require all public accessible restrooms, including all schools, to provide hand sanitizers either in or at the exit from the restroom facility.
