A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section, designated §46A-6-111 , relating to general consumer protection; and electronic scanners and shelf prices.

Be it enacted by the Legislature of West Virginia:
That the Code of West Virginia, 1931, as amended, be amended by adding thereto a new section, designated §46A-6-111
, to read as follows:
ARTICLE 6. GENERAL CONSUMER PROTECTION.
§46A-6-111. Electronic scanners and shelf prices.

Businesses which use electronic scanners to price consumer products must display the prices of the products on the shelf, either above or below the product, in a conspicuous and legible manner. The shelf label must also include unit prices, product codes and descriptions. When there is a difference in the price of the product on the shelf and at the scanner, the consumer is permitted to purchase the product at the lower price.



NOTE: This bill requires businesses which use scanners to price items at the checkout counter or register, to post prices on the shelf, legibly and in a conspicuous manner; and if the price posted differs from that on the scanner, then the consumer may buy the item at the lower of the two prices.
