A BILL to amend the Code of West Virginia, 1931, as amended, by
adding thereto a new section, designated §29-6-29, relating to
demographic information of state officers and employees;
requiring the Director of the Division of Personnel to collect
and report the demographic information; and requirements.
Be it enacted by the Legislature of West Virginia:
That the Code of West Virginia, 1931, as amended, be amended
by adding thereto a new section, designated §29-6-29, to read as
follows:
ARTICLE 6. CIVIL SERVICE SYSTEM.
§29-6-29. Demographic information.
(a) The Director of the Division of Personnel is authorized to
develop a demographic information survey or other means to gather
information from state employees and officers to assist the Governor and the Legislature in addressing current and future
issues relating to employment, retirement, insurance and health
benefits.
(b) The following information should be gathered from state
employees and officers:
(1) Educational background;
(2) Military service, including:
(A) Current membership in the National Guard and Reserve, or
any other branch of the military; or
(B) Retired from the National Guard and Reserve, or any other
branch of the military;
(3) Type of health insurance coverage including the state's,
the Department of Defense's health care program for members of the
uniformed services and their families, and any other coverage;
(4) Type of retirement plan including the state's;
(5) Type and name of pension plan;
(6) The year an officer or employee plans to retire from the
state; and
(7) Any other information the director considers pertinent to
achieve the purpose of this section.
(c) If a survey is used then it should be as short and easy to
fill out as possible.
(d) The survey or other means used shall not include:
(1) The identity of the state officer or employee;
(2) The place of employment within the state of the officer or
employee; and
(3) Any other personal information.
(e) The demographic information shall be collected by the
Division of Personnel and reported to the Governor and Legislature
by January 1, 2010. After the initial collection of information
and report, the Division of Personnel shall update, collect and
report demographic information every two years by January 1.
