A BILL to amend and reenact §30-4-13 of the Code of West Virginia, 1931, as amended; and to amend said code by adding thereto a new section, designated §30-4-13a, all relating to the practice of dentistry; and updating the requirements for dental intern, dental resident and dental teaching permits.

Be it enacted by the Legislature of West Virginia:

    That §30-4-13 of the Code of West Virginia, 1931, as amended, be amended and reenacted; and that said code be amended by adding thereto a new section, designated §30-4-13a, all to read as follows:

ARTICLE 4. WEST VIRGINIA DENTAL PRACTICE ACT.

§30-4-13. Dental intern or dental resident permit.

    (a) The board may issue a dental intern or dental resident permit to an applicant who:

    (1) Has been accepted as a dental intern or dental resident by a licensed hospital or dental school with an established dental department;

    (2) Is under the supervision of a licensed dentist;

    (3) Has graduated with a degree in dentistry from an accredited dental college, school or dental department of a university;

    (4) Has paid the applicable fees; and

    (5) Meets any other requirements specified by the board.

    (b) The dental intern or dental resident permit may be renewed and expires on the earlier of:

    (1) The date the permit holder ceases to be a dental intern or dental resident; or

    (2) One year after the date of issue.

    (c) While the dental intern or dental resident permit is in effect, a permittee is:

    (1) Subject to the restrictions and requirements imposed by this article; and

    (2) Not allowed to receive any fee for service, other than a salary paid by the hospital or dental school.

§30-4-13a. Dental teaching permit.

    (a) The board may issue a dental teaching permit to an applicant who is not licensed to practice dentistry in this state and who meets the following conditions:

    (1) Shall have an authorization to practice dentistry in another jurisdiction or has been eligible for an authorization to practice dentistry in another jurisdiction; and

    (2) Has met, or been approved under, the credentialing standards of a dental school or an academic medical center with which the person is to be affiliated: Provided, That the dental school or academic medical center shall be accredited by the Commission on Dental Accreditation or the Joint Commission on Accreditation of Health Care Organizations;

    (b) A dental teaching permit is valid for one year and may be renewed. To renew a dental teaching permit, the applicant shall:

    (1) Submit to the board a written recommendation from the dental school dean;

    (2) Successfully complete the West Virginia Dental Law Examination;

    (3) Pay the applicable renewal fees;

    (4) Complete the applicable continuing education requirements; and

    (5) Have no disciplinary actions taken or pending against him or her by any jurisdiction.

    (c) A person who has been issued a dental teaching permit may:

    (1) Teach at a dental school or college offering a doctoral degree in dentistry in this state, at a teaching hospital adjacent to a dental school or at an academic medical center; and

    (2) Practice dentistry at a dental school or college offering a doctoral degree in dentistry in this state, at a teaching hospital adjacent to a dental school or at an academic medical center.

    (d) While the dental teaching permit is in effect, a permittee is:

    (1) Subject to the restrictions and requirements imposed by this article; and

    (2) Not allowed to receive any fee for service, other than a salary paid by the dental school or academic medical center.
