A BILL to amend and reenact §29-4-15 of the Code of West Virginia, 1931, as amended, relating to designating specific criteria for seals of notary commissioners.

Be it enacted by the Legislature of West Virginia:

    That §29-4-15 of the Code of West Virginia, 1931, as amended, be amended and reenacted to read as follows:

ARTICLE 4. NOTARIES PUBLIC AND COMMISSIONERS.

§29-4-15. Seal of such notary commissioner.

    Every such commissioner shall provide an official seal on which shall be inscribed his or her name and residence and the words "Commissioner for West Virginia". An impression or stamped imprint of such seal, together with his or her signature, shall be forthwith transmitted to and filed in the office of the Secretary of State.

    (a) Every notary commissioner shall provide an official seal. The seal shall be a rubber stamp and shall contain:

    (1) The words "Official Seal";

    (2) The words "Commissioner for West Virginia";

    (3) The name of the notary commissioner exactly as he or she writes his or her official signature;

    (4) The notary commissioner’s resident city and sate;

    (5) The words "My Commission Expires" and the date of expiration of the notary commissioner’s commission.

    (b) Every notary commissioner shall file a stamped imprint of the seal, together with his or her signature, in the office of the Secretary of State.

    (c) No person holding a commission on the effective date of the reenactment of this section in the regular session of 2011 is required to obtain or use a rubber stamp seal with these specifications prior to the expiration of that commission.
