WVC 30 - 1 - 16
§30-1-16. Liability limitations of peer review committees and
professional standards review committees.
No member of a peer review committee or a professional
standards review committee of a state or local professional
organization, including, but not limited to, committees
established to review the practices of doctors of chiropractic,
doctors of veterinary medicine, doctors of medicine, doctors of
dentistry, attorneys at law, real estate brokers, architects,
professional engineers, certified public accountants, public
accountants or registered nurses shall be deemed liable to any
person for any action taken or recommendation made within the
scope of the functions of the committee, if the committee member
acts without malice and in the reasonable belief that such action
or recommendation is warranted by the facts known to him after
reasonable effort to obtain the facts of the matter as to which
such action is taken or recommendation is made.
