§28-5-34. When estate committed to sheriff as committee.
If the person so appointed refuse the trust, or fail to give
bond as aforesaid, the county court, on like motion, shall, or
such court may in the first instance, commit the estate to the
sheriff of the county, who shall be the committee, and he and the
sureties on his official bond shall be bound for the faithful
performance of his trust.
