House Majority Leader Boggs Applauds Passage of H.B. 2362

House Majority Leader Brent Boggs (D-Braxton) applauded the work of the West Virginia Legislature in passing House Bill 2362 (H.B. 2362), legislation that will increase penalties for financial exploitation of an elderly person or incapacitated adult. Delegate Boggs was the lead sponsor of this bill and worked to shepherd it through the legislative process.

Financial exploitation occurs when a person intentionally misappropriates or misuses the funds or assets of an elderly person, protected person or incapacitated adult. This bill makes financial exploitation a larceny and requires an offender to pay restitution to the victim or the victim’s estate if the victim is now deceased, in addition to any other penalties assessed.

“I am grateful to the members of the West Virginia Legislature for their support for and endorsement of H.B. 2362, which provides an avenue for victims of financial exploitation to seek restitution for financial crimes committed against them,” Boggs stated. “This is such an important piece of legislation to protect our state’s seniors,” he added. The Majority Leader is pleased the bill has completed legislative action and urges the acting governor, Senate President Earl Ray Tomblin, to sign this legislation into law as soon as possible.
