Delegate Eldridge Announces Passage of the Pain Capable Unborn Child Act in the House

CHARLESTON, W.Va. - Delegate Jeff Eldridge (D-Lincoln) is pleased to announce that House Bill 2568, the Pain Capable Unborn Child Act, was passed in the House. The passage came after vigorous debate among the House Delegates.

Delegate Eldridge spoke on the floor in support of the bill stating that all should have a chance to live and experience life. He felt that all life should be preserved and held important, born or not.

“We were all born in this world and we need to pay it forward. I encourage all to vote in favor of this bill and protect the life of all people,” said Delegate Eldridge.

The bill would ban abortions performed after twenty-two weeks of gestation. This twenty-two week mark is determined within the bill to be the point where fetuses can feel pain. Penalties for the physician involve a meeting before a conduct board and possible loss of medical license.

The bill is headed into the Senate. The Senate will determine committee assignments where the bill will be further deliberated. Once the bill exits committee, the Senate floor will debate its passage.
