Fiscal Note Summary
Effect this measure will have on costs and revenues of state government.
The purpose of this bill is to provide for mandatory insurance coverage for amino acid based formulas.
The Department has multiple programs that provide coverage of these types of disorders (Medicaid - through age 20, Children's Health Insurance Program - through age 19, Children with Special Health Care Needs). Coverage exists for all listed types of conditions.
Coverage of medical foods for these disorders is currently covered by the Department's Medicaid program for children that are 100% tube fed. Coverage is also provided by the Department's Children with Special Health Care Needs for those children that are not 100% tube fed, excluding those above 200% of FPL.
The Department does not anticipate a fiscal impact associated with this bill as these disorders are currently covered. Children with Special Health Care Needs currently covers food costs for Medicaid children and the CHIP program. These costs could be shifted to either program causing no net change in cost.

Memorandum
The Children with Special Health Care Needs currently controls costs through highly specialized nutrition clinics which include feeding and swallowing specialists. Without this check and balance, physicians (through their own admission) tend to prescribe more product than the families actually need which drives cost up.
