Effect this measure will have on costs and revenues of state government.
The purpose of this bill is to permit persons who are twenty-one years of age or older to operate or be a passenger on a motorcycle without a helmet if they have held a license valid for the operation of a motorcycle for a minimum of two years.
The Department does not estimate a fiscal impact related to this bill as it does not impact covered Medicaid benefits or eligibility.

Explanation of above estimates (including long-range effect):
Memorandum
The proposed legislation does not impact covered Medicaid benefits or eligibility. However it is possible that circumstances could occur as a result of individuals choosing not to wear helmets that could potentially in certain situations increase Medicaid costs. For example a Medicaid member may choose not to wear a helmet and may sustain an injury due to not wearing a helmet, and if so that member's resulting medical claims would increase the Medicaid expenditures for the difference in injuries sustained vs. potentially lesser injuries if the member had chosen to wear a helmet. Another example is the possibility that an individual not eligible for Medicaid could sustain injuries significant enough to result in loss of income that would render that individual becoming eligible for Medicaid, at which point the Medicaid program costs would have increased as a result of this change in safety equipment requirements. There is not data available to predict whether those circumstances would occur or related costs, if any, and in the event they did occur there are not data reporting systems in place to determine costs specifically related to whether or not medical costs were due to this type of accident or whether or not a member was using safety equipment.
