Effect this measure will have on costs and revenues of state government.
This proposed legislation changes the ages used to determine if someone has committed Sexual Assault in the 3rd degree. As of FY2015, the WVDOC had 151 offenders incarcerated for 3rd degree Sexual Assault, but is unable to determine how many of those or how many new offenders would fall into the new category of 4th Degree rather than 3rd Degree. However, for each such offender, the State of West Virginia would experience savings of $28,369 per year they were not incarcerated (average annual cost per year per inmate).
