    The West Virginia Department of Transportation, Division of Highways (WVDOH) is responsible for the construction, maintenance and operations of the road system in the State of West Virginia which represents over 92% of the road system in the State. The Commissioner of Highways is provided broad authorities to meet the overall mission of the organization including the use of private labor in emergency situations, therefore, it is anticipated there is no cost implication.

    The Commissioner of Highways, in accordance with W. Va. Code § 17-2A-8(27) and § 17-2A-8(34), may contract for the construction, improvement and maintenance of the roads and purchase materials, supplies and equipment required for the state road program and system. Additionally, W. Va. Code § 17-2A-8(39) permits the Commissioner of Highways to take actions necessary to alleviate any conditions as the Governor may declare to constitute an emergency, whether or not the emergency condition affects areas normally under the jurisdiction of the Division of Highways. The Commissioner may also exercise jurisdiction, control, supervision and authority over local roads, outside the state road system, to the extent determined by him or her to be expedient and practicable. In accordance with W. Va. Code § 17-4-19, the Commissioner has the authority to bid out all work for construction and reconstruction of state roads and bridges, and the furnishing of all materials and supplies, and for the repair thereof, which would include snow removal and ice control activities. Proposed H.B. 2561 is read to permit the Commissioner of Highways to contract with private providers or contractors for necessary emergency maintenance operations which may include but are not limited to, snow and ice removal and cleaning of debris from and beside roadways. Proposed H.B. 2561 does not appear to have any significant financial implications, as it would expressly codify the Commissioner’s currently-existing authority. The financial impact would be the difference between the cost of using the Division’s workforce, equipment, and materials and the cost of using a private contractor.
