Effect this measure will have on costs and revenues of state government.


The stated purpose of this bill is to provide for the creation of a Department of Commerce; the reorganization of the Public Land Corporation; the restructuring and reorganization of the West Virginia Development Office; the restructuring and reauthorization of the School Building Authority, the Water Development Authority, the Economic Development Authority, the Infrastructure and Jobs Development Council, the Housing Development Fund, the Jobs Investment Trust, the Public Energy Authority, and the Educational Broadcasting Authority; and the reorganization and restructuring of the Council for Community and Economic Development. According to our interpretation, passage of this bill will have no impact on revenues. While the transfer of oversight of a number of State divisions, agencies and boards to another Executive Branch entity may result in additional costs being incurred by the entity to which oversight is transferred, the entity from which the division, agency or board was transferred should experience a decline in costs of a similar magnitude. There would be no net increase in administrative costs.

Explanation of above estimates (including long-range effect):

Memorandum


The stated purpose of this bill is to provide for the creation of a Department of Commerce; the reorganization of the Public Land Corporation; the restructuring and reorganization of the West Virginia Development Office; the restructuring and reauthorization of the School Building Authority, the Water Development Authority, the Economic Development Authority, the Infrastructure and Jobs Development Council, the Housing Development Fund, the Jobs Investment Trust, the Public Energy Authority, and the Educational Broadcasting Authority; and the reorganization and restructuring of the Council for Community and Economic Development. In addition to other changes, proposed WV Code §5B-2E-5 generally changes references to the director of the development office to the executive director of the development office. However, some references to the director of the development office were unchanged. The enumerated list of agencies and boards within the Department of Revenue in proposed WV Code §5F-2-1(k) does not include the following agencies that are included in WV Code §11B-1-2: The State Budget Office, The Municipal Bond Commission, The Office of Tax Appeals, and The State Athletic Commission. Although proposed WV Code §5F-1-2-(a)(7) indicates that the Department of Tax and Revenue should be the Department of Revenue (as previously enacted within WV Code §11B-1-1), the proposed amendment to WV Code §29-22-18a(d)(6) still refers to the Secretary of the Department of Tax and Revenue.
