Fiscal Note Summary
Effect this measure will have on costs and revenues of state government.
The purpose of this bill is to include pharmacy benefits manager within the definition of third party administrator; to impose reasonable restrictions on audits conducted by pharmacy benefits managers, including an internal appeal process; and to require pharmacy benefits managers to provide notice to purchasers, pharmacies, and pharmacists' information relating to maximum allowable costs.
As written, the Department of Health and Human Resources (DHHR) does not estimate any fiscal impact from the proposed legislation. Please see note in the memorandum section.

Memorandum
Although there is no anticipated cost to the Department from the proposed legislation, if the legislation is passed there may be modifications required to the existing Medicaid Managed Care Organization (MCO) contracts to incorporate the provisions in this legislation by reference.
