Memorandum


There are areas of this legislation that are unclear, as outlined below: - §5A-1-10(a) states that purchases for commodities and services by spending units and political subdivisions shall be based on a competitive basis, except during a state of emergency; however, current law provides for purchases for non-competitive basis in addition to state of emergencies. These include sole source purchases, purchases $2,500 or less, and other emergency purchases. - §5A-3-1(f) language is not clear of its meaning or requirements. The Purchasing Division oversees 100% of purchases under its authority. The division is unsure of the intent of this part of the legislation. - §61-5A-7 relating to bid rigging may conflict with penalties that already exist in West Virginia Code §5A-3.
