Memorandum


1. The bill provides that the DOH shall propose legislative rules adopting a “permissive yellow rule” meaning a driver can legally enter an intersection during the yellow interval and a violation occurs if the driver has not cleared the intersection after onset of red. WV State Code §17C-3-5(b)(1) states: Whenever traffic is controlled by traffic-control signals exhibiting the words "go,""caution" or "stop," or exhibiting different colored lights successively one at a time, or with arrows, the following colors only shall be used and said terms and lights shall indicate and apply to drivers of vehicles and pedestrians as follows: (b) Yellow alone or "caution" when shown following the green or "go" signal: (1) Vehicular traffic facing the signal is thereby warned that the red or "stop" signal will be exhibited immediately thereafter and such vehicular traffic shall not enter or be crossing the intersection when the red or "stop" signal is exhibited. 2. It would appear that language currently exists in State Code addressing the intent of HB4194. 3. The DOH adopted the most recent version (2009) of the Manual on Uniform Traffic Control Devices (MUTCD) on January 10, 2012 by Commissioner’s Order. As such, it is the standard for traffic signal design and operation. 4. As we understand it, there does not appear to be any impact from the bill and it would require duplicative rules and regulations.
