This bill removes Upshur County from the 26th Judicial Circuit and adds it two a new judicial circuit drawn as the 32nd Judicial Circuit. The bill would also require a new judge be added to serve in the new circuit.

Memorandum


Please note that Article VIII, Section 5, of the West Virginia Constitution, provides "...the legislature, at any session thereof, held in the odd-numbered year next proceeding the time for the full term election of the judges thereof, may rearrange the circuits and may increase or diminish the number of circuits." The circuit judges will next be elected in 2016; therefore, judicial circuits can not be realigned until 2015.
