Fiscal Note Summary
Effect this measure will have on costs and revenues of state government.
The purpose of this bill is to create an informal dispute resolution process available to behavioral health providers licensed by the Department of Health and Human Resources for orders or citations of deficient practices. Estimations are based on current requests for dispute resolutions received by the behavioral health program, as well as similar services offered by the nursing home program. Costs associated with this bill are estimated to be minimal and thus absorbed within the current budget.

Explanation of above estimates (including long-range effect):
Memorandum
The bill includes provisions for reimbursement of costs by the licensee. However, the bill may cause delays in resolution of the dispute. If delays result in the license revocation for more than 60 days, it may result in loss of Federal IV-E funding. This is due to the ineligible status of the facility, where the services would have otherwise been reimbursable. The eligibility of the facility would be restored once the license is restored, however the revenue loss during the suspension may not be recoverable.
