Fiscal Note Summary


Effect this measure will have on costs and revenues of state government.


The purpose of this bill is to assess penalties for excessive tardy minutes for primary and secondary school students. Beginning with the 2013/2014 school year, all unexcused minutes a student is tardy shall be calculated and recorded, and when the student reaches a half day the student will be considered absent one half day. These shall be enforced as unexcused absences and are eligible for prosecution for guardians and students.

Explanation of above estimates (including long-range effect):


There is insufficient data to calculate the financial impact of this proposed legislation; however, it is anticipated that the county boards of education would see increased costs in order to implement the proposed changes. Schools with limited clerical resources may need to hire additional part-time clerical or data entry personnel in order to track tardy minutes for all students. Additional central office attendance staff may also be required depending on the existing resources for handling truancies. In addition, the current attendance module of WVEIS does not have the capability to track tardy minutes. The West Virginia Department of Education would incur additional costs in order to program the WVEIS system to track the minutes. Once developed, county attendance directors and other county personnel would require training on how to use the revised program.
