This bill appears to remove the maximum sentence of two years for these offenders and does not specify a new cap, which would allow significantly longer sentences to be implemented. The West Virginia Division of Corrections has no method to predict how many offenders would be affected by this longer maximum sentence nor what the average sentence would be. However, for each offender sentenced in this manner the State of West Virginia could expect to pay up to $24,447 per additional year they are incarcerated ($24,447 average annual cost per inmate in FY2012 x 5 years).
