Effect this measure will have on costs and revenues of state government.
The West Virginia Division of Corrections has no method to predict how many offenders would be affected by this legislation. However, for each offender sentenced in this manner the State of West Virginia could expect to pay up to $24,447 ($24,447 average annual cost per inmate in FY2012). In addition, the wording of this penalty (not less than one year) appears to allow longer sentences if chosen by the sentencing Judge. If this was the intent then the fiscal impact could be much higher.
