Effect this measure will have on costs and revenues of state government.
This bill would have a positive fiscal impact on the West Virginia Division of Corrections (WVDOC). As of June 30, 2012, the WVDOC had a total of 34 offenders incarcerated for 3rd offense shoplifting and 6 offenders incarcerated for 2nd offense petit larceny. These offenders typically serve about 1 to 2 years in prison. Assuming, an average length of stay of one year, this bill could save the WVDOC up to $977,800 per year, once the currently incarcerated offenders are released ($24,447 average cost per inmate in FY2012 x 40 offenders.
