: The stated purpose of this Joint Resolution is to provide for various amendments to the Constitution of the State of West Virginia creating the office of lieutenant governor in the executive department. The Joint Resolution provides that the lieutenant governor shall serve as head of an executive department as designated by the governor; provides for the joint election of the governor and lieutenant governor; provides for a method of resolving contested joint elections for the offices of governor and lieutenant governor; provides for the lieutenant governor to become governor in case of a vacancy in the office of governor; provides for the lieutenant governor to exercise the powers and perform the duties of the office of governor whenever the governor becomes unable to exercise the powers and perform the duties of the office of governor; and provides for the filling of a vacancy in the office of lieutenant governor. As written, the Joint Resolution is fiscally neutral. As stated above, the Joint Resolution specifies that the lieutenant governor shall serve as head of an executive department. No new executive department would be created for the position of lieutenant governor. The lieutenant governor would occupy the office of an existing head of an executive department. Therefore, the staff, supplies, and office space needed for the lieutenant governor would be the same as that for the current head of the executive department whose position the lieutenant governor would occupy. When not exercising the powers and performing the duties of the office of governor, the lieutenant governor would receive the already-established statutory salary of the office within the executive branch that he or she holds. The Joint Resolution is, therefore, fiscally neutral.
