Effect this measure will have on costs and revenues of state government.
The proposed legislation provides the ability for all boards and commissions licensees/employees to be backgrounded. Based upon the anticipated number of persons requiring criminal background checks addressed within Chapter 30, the West Virginia State Police will require the following additional resources - five fingerprint technicians, one senior fingerprint technician, and four office assistants. Equipment costs would include two fingerprint workstations with user licenses and four criminal workstations. An unknown cost would be space requirements to accommodate ten staff members and their related equipment.

Memorandum
This legislation, while being broadly intended, will not permit any individual boards and commissions the ability to access criminal records under P.L. 92-544. Once a board/commission enacts a legislative rule more narrowly defining specific authorization under FBI established criteria, access to the checks would be granted.
