This is the agency's second time completing the Fiscal Note. The first Fiscal Note was completed on January 17, 2012 at 10.48 a.m. This measure has language where an employee's salary would not be decreased by the WVDOP's review and reclassification of an employee within the civil service system. It does not state whether salary would stay the same or increase depending on the WVDOP's review. Therefore it would be difficult to say whether there is no impact on the costs and revenues of state government or an increase due to the necessity of a WVDOP review of each employee subject to reclassification in civil service which could lead to no salary increase or a possible salary increase but not a decrease. Perhaps WVDOP could give an estimate.

Explanation of above estimates (including long-range effect):

It does not state whether salary would stay the same or increase depending on the WVDOP's review. Therefore it would be difficult to say whether there is no impact on the costs and revenues of state government or an increase due to the necessity of a WVDOP review of each employee subject to reclassification in civil service which could lead to no salary increase or a possible salary increase but not a decrease. At this time the WVABCA cannot privide an estimate without the WVDOP review. Perhaps WVDOP could give an estimate.



Memorandum


The bill would make all employees except the Commissioner, Deputy Commissioner and division directors (unless currently civil service then remain until they would leave the position) part of the classified service system. The WVABCA is not sure why division directors are included since they are all working directors/supervisors. This bill requires WV DOP to conduct a review by July 1, 2013 of each employee. It is not clear if this is possible for WV DOP or what costs the WV DOP may have to complete the review. Further it is not clear whether this review would supersede the current review being conducted by WV DOP or be in addition to it. The bill does not account for whether an employee would have to test to meet current civil service qualifications or just be granted the position. Further the bill does not account for the situation where an employee tests for a civil service position and does not qualify for a position. This bill would affect 13 currently filled WVABCA positions (10 in Enforcement) or 21 total WVABCA positions, including vacant positions, with 15 positions in Enforcement. Without the review of each employee contemplated in the bill it is difficult to estimate the fiscal impact.
