Effect this measure will have on costs and revenues of state government.


This bill originally increased the number of magistrate court deputy clerks the West Virginia Supreme Court of Appeals is authorized to employ from seventy-two to seventy-seven. The House Judiciary Committee amended the bill to increase the number to seventy-eight. The magistrate court deputy clerks are paid according to a two-tier system. Deputy Clerks paid on Level 1 are paid $36,048 annually. Deputy Clerks paid on Level 2 are paid $39,348 annually. Since this bill does not reflect where those clerks will specifically be placed We have calculated this fiscal note on the highest possible salary. It is estimated that each additional position will cost $59,249 annually. This bill is necessary because several counties have lost deputy clerks that were funded by worthless checks. Since magistrate courts now collect debit/credit cards, the worthless check funding has drastically decreased although the transactions are still occurring. The loss of the worthless check funding for these deputy clerks has resulted, and will continue to result, in the dismissal of some deputy clerks. This fiscal note reflects the amendment of the House Judiciary Committee.
