Effect this measure will have on costs and revenues of state government.
The criminal penalties for this statute will not change if the proposed legislation is adopted, however the bill does clarify issues of consent and adds the terms “sexual contact”. As of this date, the WVDOC has not received any inmates sentenced to our custody under this law. However, for each additional inmate sentenced if this bill becomes law, the state can expect a cost of $23,674 per year they are incarcerated (average cost per inmate in FY 2011). Offenders in WVDOC custody, serving 1-5 year sentences typically discharge their sentence after 2.5 years (23,674 x 2.5 = $59,185) if they do not receive parole earlier.
