Effect this measure will have on costs and revenues of state government.
West Virginia Code Section 29-22-18a(j)(1)(D) provides funding for high school and middle school athletics in the amount of $10 million out of surplus excess lottery revenue funds. In West Virginia Code Section 29-22-18a(j), the Legislature makes a statement of future intent but does not actually appropriate money for a purpose. Subsection (j)(2) states:
"(2)The provisions of this subsection may not be construed by
any court to require any appropriation or any
specific appropriation or level of funding for the purposes
set forth in this subsection."
Subdivision (2) above makes it clear that subsection (j)(1)(D)by itself does not appropriate the $10 million for high school and middle school athletics. The fiscal effect of the bill is no change.

Memorandum
W. Va. Code Section 29-22-18a(j)(2) makes it clear that subsection (j)(1)(D) by itself does not appropriate the $10 million for high school and middle school athletics. Please note that Excess Lottery Fund surplus is is declining each year based upon current Lottery projections. The fiscal effect of this bill is no change.
