Fiscal Note Summary
Effect this measure will have on costs and revenues of state government.
The WVDOC cannot predict how many offenders, who under current law would be convicted of a drug crime and sentenced to 1-15 years, would be sentenced to this enhanced 3-15 year term. However, for each offender sentenced under this enhancement the State could expect minimum additional costs of $48,532 per offender ($24,266 was the average cost per inmate in FY2010 x 2 additional years before parole eligibility). The WVDOC, as of June 30, 2010, had 9 offenders whose most serious crime was distribution within 1000 feet of a school.
