Fiscal Note Summary

Effect this measure will have on costs and revenues of state government.

To date there have been no Corrections staff who have been convicted of this offense actually sentenced to serve a prison term. Therefore, it is difficult to predict the fiscal impact of this change. However, if a staff person were sentenced under the current 1-5 sentence you would expect a minimum cost of $24,266 (average cost per year for FY2010) and a maximum cost of $60,665 (provided that the offender discharged at 2.5 years with good time). Under the proposed sentence the State could expect a minimum cost of $242,660 and a maximum cost of $291,192 (parole eligible after 10 years x $24,266 and discharged with good time after 12 years x $24,266). These estimates to not consider increased average yearly costs per inmate and are based on FY 2010 numbers.
