Explanation of above estimates (including long-range effect):
The State currently remits the revenues from the candidate filing fees to the several counties based on population. Any new revenue from this proposed language would be distributed in the same manner. Therefore cost and revenue at the State level would be neutral.
Memorandum
The United States District Court 4th Circuit ruled a prior West Virginia law with similar language to be unconstitutional. (Phillips v. Hechler, 2000, 120 F.Supp.2d 587)
