Fiscal Note Summary


Effect this measure will have on costs and revenues of state government.


This Bill gives the Ethics Commission standing to, in limited circumstances, petition a Circuit Court for preliminary injunctive relief if a local governmental official is expending taxpayer funds in violation of the Ethics Act and the local governmental unit will be irreparably harmed if the expenditure is not stopped during the pendency of the Ethics Commission proceeding. If an elected or appointed local governmental official is found guilty of violating the Ethics Act, the Bill also gives the Commission authority to initiate removal proceedings in Circuit Court in accordance with the existing process set forth in the West Virginia Code for the removal of local elected or appointed public officials.

Memorandum


At present, this Bill would have no fiscal impact because if it is necessary to file a petition for preliminary injunction or for removal in Circuit Court, this may be accomplished with existing Commission staff.
