Explanation of above estimates (including long-range effect):
Effect of Billing Counties ½ of Per-Diem Rate for First Day of Incarceration
Inmates billed 1 day only 1/1/08 to 12/31/08 11755
Per-Diem Rate FY 2010 48.25
Total $ 567,178.75
½ Per-Diem Rate-Revenue Lost to West Virginia Regional Jail Authority $ (283,589.38)
Note: Reduction of the Per-Diem Rate for the First day of incarceration of an inmate would increase the Per-Diem Rate for the next fiscal year by about $0.20 per day because the West Virginia Regional Jail Authority is funded by Special Revenue
Effect of State paying ½ cost of County and City Inmates
Budget Sub Total $78,964,889.00
Less Working Capital at end of 2008 11,462,119.04*
Current Budget Basis for Per-Diem Rate
FY 2010 $67,502,769.76
½ Cost to State $33,751,384.88
*Please note that the working capital amount is a deduction based on the additional working capital that was available at the end of FY 2008. That amount would be subject to change based on working capital available at the end of FY 2009.
Memorandum
This bill does not specify how the Per-Diem charges that are presently made by DOC would be considered. In FY2008 the DOC was billed for 32.15% of the per-diem billing. Based on the 2010 budget the amount received by DOC would be $21,702,140.48. In the event that they would be under the same formula as the Counties they would be paying ½ , which would be $10,851,070.24. Additionally the Federal per-diem rate is currently $56.00 for prisoners held in the regional jails for the Federal Government. In FY 2008 the U.S. Government billing amounted to 6.78% of the budget. Based on the FY2010 Budget the amounts billed to the Federal Government would amount to $4,576,687.65.
