Fiscal Note Summary

Effect this measure will have on costs and revenues of state government.

The increase in funeral expense will provide an extra $1,000 per funeral and would apply to approximately 30 funerals per year for families of victims. For dependent's economic loss there are an average of three claims per year to which this increase may apply; however, this amount would greatly benefit these families impacted by this increase of $15,000 per claim.

Explanation of above estimates (including long-range effect):

The increase in funeral expense is requested based upon the average cost of a funeral in West Virginia. Families of victims are experiencing hardship due to the rising costs of funerals and burials. The impact to th CV Fund is minimal and funds are available for the requested increase. The increase in dependent's economic loss will assist families of victims where the victim was employed and supported the family.

Memorandum

The increase in dependent's economic loss will not have a great impact upon the Fund since very few claims will be at the $50,000 loss limit. Our office had three claims which would have been impacted by an award to the family of $50,000.
