The purpose of this bill is to provide a copy of advanced directives in the form of living wills, medical powers of attorney and combined medical powers of attorney and living wills to public employees and retirees covered by the PEIA. The Public Employees Insurance Agency presently provides some information regarding advanced directives for its members including web links from its home page. The first year estimated annual cost of printing and mailing of the advanced directives with the information materials required for the members would be approximately $68,000. Operational costs (personnel expenditures, etc.) to accomplish this task would be approximately $8,000. Total costs to the PEIA for the next three years using an assumed rate of 5% inflation for printing, postage and personnel expenditures are estimated at: FY-2009 $ 76,000 FY-2010 $ 79,800 FY-2011 $ 83,790 Total $ 239,590 While providing the advance directives with instructional materials to its members is not a substantive fiscal impact to the PEIA the chief concern to the agency would be the exposure to possible litigation resulting from providing specific forms or directives to its members. It is conceivable that this type of mailing could result in members misunderstanding its intent, use the advance directive incorrectly or later find that those materials provided by PEIA did not result in the members desired purpose. If this should occur legal action may be the result. The possible cost to the agency from these types of torts cannot be estimated. It is the preference of the PEIA that it retain its present standing as a conduit to other professional organizations better able to serve our members that are interested in obtaining advanced directives.
