Fiscal Note Summary


Effect this measure will have on costs and revenues of state government.


Current code provides an exemption from screening/fencing salvages yards that were licensed prior to 1988. The WVDOH is required by 23 USC 136 to certify that we enforce State Code regarding salvage yards located along the Interstate Highway System and primary roadways in the National Highway System in order to retain federal funding. The penalty for non-certification is a 10% loss of federal monies allocated for the fiscal year. Should this legislation pass, the DOH would lose $17,830,000 in federal funds for FY 2008.
