Explanation of above estimates (including long-range effect):


There is no additional cost or cost savings to the State of West Virginia as a result of the proposed legislation as the allowances under the Public School Support Program (PSSP) are not impacted. Any potential financial impact would be on the county boards of education. However, there is insufficient data to determine what potential additional costs or cost savings the counties would encounter as a result of this proposed legislation. As the proposed legislation is currently written, it would authorize county boards to offer half day positions to school service personnel. Currently, WV State Code 18A-4-8a already allows school service personnel to work for a half day. Please see the Memorandum section for more details. As the proposed legislation is currently written, it would authorize school service personnel to be employed beyond one full time position, however, WV State Code 18a-4-8h currently prohibits school service personnel from becoming employed in more than one regular full day position or two one-half day positions. Please see the Memorandum section for more details.



Memorandum


WV code 18A-4-8a already allows service personnel to be employed for a half-day. Please see excerpt of this section below: For school year 2023-2024 and continuing thereafter, the minimum monthly pay for each service employee whose employment is for a period of more than three and one-half hours a day shall be at least the amounts indicated in the State Minimum Pay Scale Pay Grade Schedule set forth in this subdivision and the minimum monthly pay for each service employee whose employment is for a period of three and one-half hours or less a day shall be at least one-half the amount indicated in the State Minimum Pay Scale Pay Grade Schedule set forth in this subdivision. Currently, WV Code section ยง18A-4-8h limits the number of school service personnel positions to be held by an employee. Please see excerpt of this section below: Upon the effective date of this section, no school service personnel shall be permitted to become employed in more than one regular full-day position, nor more than two one-half day positions at the same time: Provided, That nothing herein shall be construed to prohibit a school service personnel from holding an extracurricular assignment or assignments, as provided in section sixteen of this article, or summer positions, as provided in section thirty-nine, article five, chapter eighteen of this code, nor from performing extra-duty assignments, as provided in section eight-b of this article, in addition to his or her regular position. If it is the intent of the legislature to remove or modify this restriction, this section of code would need to be altered/removed. The WVDE would also recommend that the proposed legislation be reviewed with legal counsel in conjunction with the current language found in WV Code 18a-4-8a to ensure that school service personnel are not able to easily manipulate the rules to abuse the intentions of the proposed legislation.
