Effect this measure will have on costs and revenues of state government.
Senate Bill 311, if enacted, would require PEIA, the Bureau for Medical Services (BMS) and various insurance companies to provide coverage for non-stress fetal test, including an ultrasound, and tests performed remotely in a residence. This would also include reimbursement for the covered services by these certain private carriers.
SB311 would have no fiscal impact on the WV Offices of the Insurance Commissioner.

Please explain increases and decreases in personal services, current expenses, repairs and alterations, assets, other costs and revenues, including assumptions and data sources and delineation between start-up and ongoing costs. Please also include a long-range schedule of costs and revenues if fiscal impact is expected to vary in future years.
Memorandum
Senate Bill 311, if enacted, would require PEIA, the Bureau for Medical Services (BMS) and various insurance companies to provide coverage for non-stress fetal test, including an ultrasound, and tests performed remotely in a residence. This would also include reimbursement for the covered services by these certain private carriers.
SB311 would have no fiscal impact on the WV Offices of the Insurance Commissioner.
SB311 may have an impact on insurance premium rates in the private market. While an increase in health insurance premiums rates would be expected, the WVOIC does not have the data to calculate the extent of the increase. However, the WVOIC can request data from the private insurance carriers and provide any information received at a later time to a committee.
PEIA and BMS should be consulted regarding the fiscal impact to those programs.
It should be noted that SB311 does not contain language limiting the insurance benefits provided under the proposed bill to the essential health benefits (EHB) specified under section 130(b) of the Patient Protection and Affordable Care Act (PPACA). PPACA 1311 (d)(3) provides that a state must defray the cost by direct payment to enrollees or to the Plan of any state mandated benefit in excess of the EHB.
To the extent that the health insurance benefits required by SB311 do not fall within the EHB, a potential cost to the State exists.
