Memorandum
We do not have enough data to determine what the fiscal impact would be on the agency due to this not being an existing offense. Statistics of fentanyl exposure by 1st Responders, government officials etc. is not data that we possess nor have the ability to track based on current sentences.
Increasing a sentence to 2-5 years from 1-5 would would require an inmate to serve at minimum one extra year for the sentence. The Current annual cost is approximately $40,362 per year.
